European Cartel Damages Directive comes into force

The Antitrust Damages Directive comes into force at Christmas 2014. The Directive aims to make it easier for victims of a cartel infringement to enforce their claims for damages. In particular, access to evidence is to be facilitated. Following the ruling of the European Court of Justice in the Kone AG u.a./. ÖBB-Infrastruktur AG case of 5 June 2014 (Case No. C-557/12) on so-called "umbrella pricing", this is a further step towards protecting those who have been harmed by cartel infringements.
